Reasons
- This is an amended order to an order issued earlier on 29 April 2026, where I omitted to deal with a previous mediator’s order between the parties, which I now deal with in this amended order.
- Mr Timmer, representing the landlord, attended the video conference hearing. The tenants did not join the hearing as per the instructions in the Notice of Hearing and so did not attend the hearing. As the tenants were served, the hearing proceeded in their absence.
- The landlord has applied for termination of the tenancy, rent arrears, refund of the bond and reimbursement of the filing fee.
- Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
How much rent is owing?
- The landlord provided rent records which prove the amount owing to 29 April 2026, which is the end of the tenancy, which is $11,385.00. Filing fee
- Because Tauranga Rentals Limited As Agent For Louis Kelvin O’Hara And Helen Mary O’Hara has wholly succeeded with the claim I must reimburse the filing fee. Refund of the bond
- The Bond Centre is to pay the bond of $2,140.00 (BN-10083110) to Tauranga Rentals Limited As Agent For Louis Kelvin O’Hara And Helen Mary O’Hara immediately. Previous mediator’s order
- This order replaces the mediator’s order dated 9 October 2025, sealed on 9 October 2025 in application 5349183.
