Reasons
- Both parties attended the hearing. The tenant was supported by a representative of Citizens Advice Bureau.
- The landlord has applied for possession of the premises occupied by the tenant.
- The landlord has given the tenant notice terminating the tenancy and the tenant has not quit the premises within the period specified in the notice. See section 66Y Residential Tenancies Act 1986.
- On 7 February 2026 the landlord served a notice on the tenant to vacate the premises in 7 days due to and incident on 2 February 2026 where the tenant seriously assaulted another resident of the premises in the Lodge kitchen.
- In the hearing the tenant stated that there had been a history of him actually being the victim in situations and he had always paid his rent. It was explained to the tenant that this hearing and application by the landlord concerned that he had not vacated the premises after being given a notice to do so, as is permitted under the Act. The tenant said he would vacate the premises.
- The landlord is entitled to an order for possession of the premises. See section 66Y Residential Tenancies Act 1986.
- Because Kingsland Lodge Limited has wholly succeeded with the claim I must reimburse the filing fee.
