Reasons
- The landlord, represented by Ms Fuggle, attended the hearing which was conducted via video. There was no appearance for the tenant.
- The landlord has applied for termination of the tenancy for abandonment and rent arrears.
Should the tenancy be terminated?
- The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date.
- A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord. (See section 61 Residential Tenancies Act 1986).
- On 23 February 2026, the landlord became aware that the tenant had abandoned the premises. The property has been on the market. The real estate agent advised the property management company that it appeared the tenant had moved out. Items had been moved out of the property and the neighbours in the body corporate said that items had been dumped in a skip.
- The landlord tried to make contact with the tenant, but received no response. No rent had been paid since 27 January 2026.
- The landlord applied for an order for termination and on or about 10 March gained access to the property and took photos. These show that most furniture has been removed and there are several banana boxes and there along with abandoned items on the floor.
- On 11 March 2026 the landlord received an email from the tenant advising that she had relocated to Australia and apologising. She has since given 21 days’ notice.
- The landlord wants possession as soon as possible.
- Because the premises have been abandoned, and rent is in arrear, the tenancy is terminated immediately.
How much does the tenant owe?
- I am satisfied that the date the landlord became aware of the abandonment is 23 February.
- Under section 61, a tenant who abandons the premises is liable to pay the rent for any period up to and including, the expiry of the period of 21 days after the date of abandonment or the date of commencement of a new tenancy of the premises, whichever is the earlier:
- The landlord provided rent records which prove the amount owing at the end of the tenancy. The amount ordered includes rent in lieu of notice from 23 February 2026 to 15 March 2026.
- Because Lynn Property Management Limited T/A Managed Property has wholly succeeded with the claim I must reimburse the filing fee.
