Reasons
- Both parties attended the hearing which was held remotely.
- The landlord has applied for termination of the tenancy, rent arrears, reimbursement of the filing fee and payment of the bond.
- Rent was at least 21 days in arrears on the date the application was filed and continues to be in significant arrears. The last payment of rent was made on 3 March 2026 ($532.29).
- At today’s hearing the tenant advised that she had asked her case manager to have her rent redirected from her benefit and that she was unaware that this had not been done. She also stated that she was not home when she was visited by her case manager in February 2026 and that she did not receive the calls made to her because her phone was broken.
- However, I accept the evidence provided at today’s hearing that on 2 February 2026 WINZ had refused to redirect the tenant’s benefit and that the tenant had been advised of this. I also accept that the landlord had sent statements in March and April advising her of her rent arrears and that the tenant had been visited again on 28 April 2026 at which time she was again advised of her rent arrears situation. No rent payments were made.
- Further, I do not accept that the tenant was unaware that the rent had not been taken from her benefit. That would have been immediately obvious on receipt of her benefit every week.
- The tenancy is terminated because the rent continues to be more than 21 days in arrears. See section 55(1)(a) Residential Tenancies Act 1986.
- The landlord provided rent records which prove the amount as at today’s date - $2,174.63.
- Further to this I am ordering the tenant to reimburse the filing fee to the landlord because the landlord was wholly successful with this claim against her. C ter Haar 19 May 2026
