Reasons
- Mr Le Fevre, representing the landlord, attended the video conference hearing. The tenant did not join the hearing as per the instructions in the Notice of Hearing and so did not attend the hearing. As the tenant was served, the hearing proceeded in her absence.
- The landlord has applied for termination of the tenancy, rent arrears, compensation, refund of the bond and reimbursement of the filing fee. During the hearing, the landlord withdrew their compensation claim.
Should the tenancy be terminated?
- The landlord said the tenant had emailed promising to pay the rent arrears in full by 7am on the morning of the hearing. However, the landlord said that no money was received by them from the tenant before the hearing, and the last rent payment from the tenant had been on 7 May 2026.
- The landlord claimed termination of the tenancy for breach of the tenant’s obligation, provided 3 x 14-day breach notices regarding rent arrears breaches, and indicated a previous Tribunal application had also been made. However, at the hearing date, rent arrears were more than 21 days in arrears. Therefore, the tenancy is terminated. See section 56(2) Residential Tenancies Act 1986.
How much rent is owing?
- The landlord provided rent records which prove the amount owing to 14 May 2026, which is $2,115.00. Weekly rent is $460.00 so daily rent is $65.71. A further 2 days’ rent @ $65.71, for a sub-total of $131.42, is payable for 15-16 May 2026. Therefore, the tenant owes the landlord a total of $2,246.42 in rent arrears to 16 May 2026, which is the end of the tenancy. Filing fee
