Reasons

The landlord attended today’s remote hearing. The tenant did not join the call.
On 9 March 2026, the landlord applied for termination of the tenancy, rent arrears, outgoings and refund of the bond.
The rent was not in arrears on the date the application was filed. There are no breach notices in the file requiring the tenant to remedy rent arrears. The practical reality, however, is that the tenancy has ended. I consider it is appropriate to confirm that the landlord has possession.
The landlord provided rent records and a water summary which prove the amounts owing to today for rent arrears and water.
The landlord had sought termination for abandonment. The tenant gave notice on 27 February 2026, explaining that they would be vacating that week, following a burglary. The landlord conducted an inspection on 6 March 2026 and the tenant had vacated by then. The rent was paid up to 8 March 2026.
A tenancy is abandoned where the tenant leaves the premises without reasonable excuse and fails to notify the landlord, not intending to return or to meet their obligations. Rent arrears are also characteristic of abandonment (section 61 of the Residential Tenancies Act 1986).
In this case, the tenant had some reason for leaving, they notified the landlord and left the keys for the landlord to collect. They were not in arrears when they left. I am not satisfied that the tenant abandoned the premises. They were, I accept, in breach of contract by ending the tenancy before expiry of the fixed term on 1 February 2027.
The landlord said they have not yet found someone to take the tenancy. They have a prospective tenant who wants to move in from 1 May 2026. The landlord can claim rent to the date when new tenants are found, subject to their duty to take reasonable steps to mitigate their loss. While the tenancy has ended, that does not preclude a claim for loss of rent based on breach of contract. I understood the landlord intends to file a further application for vacated compensation and additional rent.
The landlord’s application has been successful. I must award the filing fee.
