- Dean John must pay rent and the debt as follows: a. By 21 weekly payments of $500.00, being $400.00 for current rent and $100.00 for the debt. b. A final payment of $476.57, being $400.00 for current rent and $76.57 for the debt. c. Payments will be every Wednesday, with the first payment on 13/05/2026 and continuing until 07/10/2026.

The balance of the debt will be payable immediately.

Reasons
- The hearing was conducted by way of video conference.
- Ms Peterson, property manager for the landlord, attended the hearing.
- The tenant, Mr John, did not attend. I attempted to contact Mr John on the telephone number ending 8969. Two calls were made, and voicemails were left on each occasion identifying myself, the Tribunal, and the purpose of the call.
- The hearing proceeded in the absence of the tenant.
- The landlord has applied for termination of the tenancy, rent arrears and refund of the bond. The tenant wants to repay the debt to avoid immediate termination.
Should a conditional termination order be made?
- Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.
- Ms Peterson sought termination of the tenancy on the basis of rent arrears. At the time of the hearing, the arrears were $2,148.57.
- However, Ms Peterson submitted that the tenant had recently made some efforts to reduce the arrears, albeit inconsistently. She advised that regular payments had been made in varying amounts and on differing days, indicating some willingness to meet obligations.
- Ms Peterson also noted that the tenant is in receipt of assistance, and expressed the view that, if payments became consistent and structured, the tenancy could potentially be sustained.
- In those circumstances, Ms Peterson requested that, rather than immediate termination, I issue a conditional order. This would allow the tenancy to continue provided the tenant complies strictly with specified payment obligations, while protecting the landlord by enabling termination if further default occurs.
- I am satisfied the tenant will pay the debt within the period specified in the order and is unlikely to commit any further relevant breach. I have granted a conditional termination order.
- The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986. Filing fee
- Because Inspire Property Management Limited As Agent For Anyos Gonczy (Inspire Holdings Limited) has wholly succeeded with the claim I must reimburse the filing fee.
