Reasons
- This application was scheduled to be heard by video conference. The tenants did not connect to the Teams link provided to them and nor did they ring in to the hearing as directed in the Notice of Hearing. My calls to both telephone numbers provided to them went unanswered and so the hearing proceeded in their absence.
- The tenants began their tenancy on 12 December 2024. Rent was paid regularly until the beginning of this year when payments became haphazard.
- I understand from the landlord that in March one of the tenants advised her that she was thinking of giving notice to terminate the tenancy.
- However, no notice was sent and on 7 April 2026, when the landlord went to do a property inspection, she found the property abandoned and a notice of termination dated 17 March 2026.
- The landlord now seeks payment of rent arrears and reimbursement of the filing fee.
- Landlords are entitled to 3 weeks’ notice of termination of a tenancy. When a property is abandoned, they are entitled to rent for those 3 weeks from the day they found that the property was abandoned.
- In this case the landlord only seeks rent arrears to the date they found that the property – that is, to 7 April 2026.
- I accept that on this date $3,535.71 was owing.
- I am also ordering the tenants to reimburse the filing fee to the landlord because the landlord was wholly successful with this claim against them. C ter Haar 11 June 2026
