Reasons

Ms Hastings attended the hearing on behalf of the landlord. There was no appearance for the tenant. 1 This amount takes into account the $200 that the tenant has paid since the tenancy terminated.

In order to assist the parties and any future adjudicator, I set out the following history to these applications.

On 6 March 2026, the landlord applied for rent arrears, water rates and termination (5462890).

Then 20 March 2026 the landlord applied for expedited abandonment and termination (5472943)

On 21 April 2026, Adjudicator Guptill dismissed 5462890 because of no appearance for either party.

The landlord applied for a rehearing because they had thought that the adjudicator was going to phone them.

On 23 April Adjudicator Guptill set application for rehearing of 5462890 down for a hearing as to whether rehearing should be granted.

A few days later, on 29 April 2026, Adjudicator Price considered the expedited abandonment application (5472943) and declined it.

That is the application that came for hearing before me today, 15 May 2026. In the meantime, the tenancy ended by consent on 6 April 2026. Therefore, the only issue for determination today is the rent arrears.

On 11 May the parties were advised of a hearing date on 28 July 2026 for application 5462890.

Before today’s hearing, the landlord asked if the two could be combined and heard today. Although initially that looked like a sensible approach, the problem is that the hearing on 28 July is not to determine rent and water rates; it is to decide whether a rehearing should be granted.

Since the tenancy has vacated, the landlord has incurred some other costs. However, the application before the Tribunal does not include those or an application for refund of bond. Although the landlord has sent all information to the tenant, the notice of hearing for today refers only to termination and rent arrears. Therefore, the other matters cannot be dealt with.

The landlord agrees that the application for a rehearing may be withdrawn. That means that the hearing on 28 July 2026 may be vacated.

The landlord will file a fresh application for refund of bond and vacated compensation, which may include water rates.

The landlord has provided rent records which prove the amount owing. At 6 April 2026, it was $4,478.57. The tenant has made four payments of $50 each, bringing the balance down to $4,278.57.

Because Advantage Realty Limited As Agent For Ryker Enterprises Limited - Daniel Mathews And Lee Johnson has wholly succeeded with the claim for rent arrears, I must reimburse the filing fee.

The landlord may choose to commence enforcement proceedings on this order or may decided to have the monetary amount for this order included in any future order that may be made.
