- Ms Bridger for the applicant appeared by teleconference together with the tenant Ms Harawira. I was advised by Ms Harawira that Mr Te Moana is unavailable and had no phone, I did not have a number to contact him on.
- The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
- Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
- The landlord provided rent records which prove the amount owing at the end of the tenancy.
- The landlord agreed to allow the tenant to remain until 5pm on Monday 20 th April 2026 and rent has been calculated until that date.
- Because Tpm Rotorua Limited As Agent For Brent Henry has wholly succeeded with the claim I must reimburse the filing fee.
