- Amadelle Go and Arcy Go owes Raven Homes Limited As Agent For Yu And Zhang Family Trust $4,985.48 (“the debt”), as in the table below.
- Amadelle Go and Arcy Go must pay rent and the debt as follows: a. By 4 weekly payments of $1,290.00, (which is $890.00 for rent and $400.00 for the debt) on Fridays the 22 May 2026, 29 May 2026, 5 June 2026 and 12 June 2026, and b. Ongoing weekly payments of $1,190.00 (which is $890.00 for rent and $300.00 for the debt) every Friday starting from 19 June 2026 until the debt is paid in full.
- Payments will be allocated in the following order: rent, rent arrears, water rates, and the filing fee.
- If the tenants fail to pay rent and rent arrears within 1 working day of the due dates: a. The tenancy at 29 Salamanca Road, Sunnynook, Auckland 0620 will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.
- If the tenant fails to pay the water rates or filing fee within 1 working day of the due dates, these will be payable immediately.
Reasons
- The landlord’s representatives and Amadelle Go (for both tenants) attended the hearing held remotely today.
- The landlord has applied for termination of the tenancy, rent arrears and refund of the bond. The tenants want to repay the debt to avoid immediate termination.
- The landlord supplied rent records proving the amount owing to 22 May 2026 is $4,800.00. The tenant agrees water bills of $157.48 are also owing.
- I award the amounts claimed and the filing fee.
- Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.
- After hearing from the tenant and the landlord, I am satisfied the tenant will make every effort to pay the debt within the period specified in the order and is unlikely to commit any further relevant breach. I have granted a conditional termination order.
- If the tenants are unable to make the repayments agreed to today, it is helpful if they keep in contact with the landlord to agree on move out arrangements.
- This order gives the landlord the right to terminate the tenancy and apply for a bailiff to enforce the possession order for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.
- The conditional termination order will lapse if it is fully complied with.
- No suppression orders were sought for the landlord, and none apply to the tenants.
