- Only the landlord’s representative attended the hearing.
- The landlord has applied for termination of the tenancy, rent arrears and payment of the bond. The premises are not a boarding house.
- The Tribunal must make a termination order where rent is 21days or more in arrears when the application was filed.
- The landlord has produced a rent statement showing that rent was more than 21 days in arrears when the application was filed and is now $1,850 in arrears.
- I have therefore made a order terminating the tenancy immediately.
- I have also ordered that this order may be enforced immediately. It seems that the tenant is not in occupation of the premises and so it will be up to the landlord to decide whether enforcement is needed or whether it can take back possession without it.
- The tenant has dumped an old mattress in the a car park of another tenancy, and he has put a table in the premises. I decline to make any order for disposal of those items. The landlord must follow the Residential Tenancies Act 1986 regarding the table. The mattress has not been left at the premises and so that is outside the Tribunal’s jurisdiction.
- The landlord has succeeded and so I have awarded the filing fee.
