John Warwood and Lucy Dunce must pay NG Property (2017) Limited as agent for Brooklyn Anglican Parish $8,975.14 immediately, as calculated in the table below:

The Bond Centre is to pay the bond of $2,160.00 (BN-25075080) to NG Property (2017) Limited as agent for Brooklyn Anglican Parish immediately.

Reasons

The landlord attended the hearing. The tenants did not attend, and the hearing proceeded in their absence.
The landlord has applied for termination of the tenancy for abandonment, rent arrears and refund of the bond.

Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned, and rent is in arrears at the hearing date. See section 61 Residential Tenancies Act 1986 (RTA). A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.
On 26 March 2026 the landlord became aware (or ought to have been aware) that the tenant had abandoned the premises. A routine inspection (and the photographs from that inspection) showed the property relatively empty with only scattered furniture. The landlord endeavoured to contact the tenants, however, to date has received no response.
Because the premises have been abandoned, and rent is in arrears, the tenancy is terminated immediately.

How much does the tenant owe?

The tenancy was a fixed term tenancy that is not due to end until 24 October 2026.
The RTA provides that where tenants in a fixed term tenancy abandon the premises, they are liable to pay rent until the date of commencement of a new tenancy or the expiry of the fixed term tenancy. See section 61(3) of the RTA.
As the landlord has only today been granted possession, I cannot know whether or when a new tenant will be found. Accordingly, I have only awarded rent arrears in accordance with the provided rent record to 20 May 2026 and amounting to $11,107.14.
There is nothing preventing the landlord from filing a further claim with the Tribunal for any additional rent (together with any other claims associated with the tenancy).
Because NG Property (2017) Limited as agent for Brooklyn Anglican Parish has wholly succeeded with the claim I must also reimburse the filing fee. R Harvey-Lane 20 May 2026
