Reasons
- The landlord attended the hearing which was conducted by video conference. The tenant did not seek to be admitted to the hearing at the scheduled time. The tenant has been served notice of the hearing to her email address which is recorded on her tenancy agreement, but not as an address for service.
- The landlord provided via screen share, a copy of email correspondence from the tenant to the landlord yesterday, in which the tenant refers directly to today’s hearing. The tenant discusses her rent arrears, the reasons for, and plans to address it.
- Strictly speaking the service requirements of the Residential Tenancies Act, 1986, (the “RTA”) have not been satisfied. However, I am satisfied the tenant is aware of today’s hearing and understands the claims.
- The landlord has applied for termination of the tenancy, rent arrears, refund of the bond and reimbursement of the filing fee.
Should the tenancy be terminated?
- Where a landlord applies to terminate for breach, and rent is at least 21 days in arrears on the hearing date, the Tribunal must terminate the tenancy. See sections 55 and 56(2) Residential Tenancies Act 1986.
- At the time of the most recent rent cycle, rent had not been paid for two weeks. Added to the existing arrears, at the hearing date rent is now more than 21 days in arrears.
- The claim is proved. The tenancy is terminated.
- The landlord is seeking termination from 18 June 2026.
