Reasons
- Only the landlord attended today’s hearing. The tenant did not attend by video, or telephone. The tribunal called the tenant on two numbers neither of which was answered. I am satisfied that the tenant was aware of today’s hearing and have proceeded in her absence.
- The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
- Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
- The landlord provided rent records which prove the amount owing at the end of the tenancy.
- The tenant has made a payment towards the rent since the application was filed by the landlord, but as the rent arrears were not extinguished in full, then the Tribunal can still terminate under s55(1)(a). As at today’s date the tenant is 19 days in rent arrears.
- Because Irentproperty Limited As Agent For Sam Helmore has wholly succeeded with the claim I must reimburse the filing fee.
