Rent was at least 21 days in arrears on the date the application was filed on the 20 April 2026. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.

The landlord provided rent records which prove the amount owing at the end of the tenancy.

The tenant’s flatmate who is still residing at the property, has paid the landlord directly $225.00 per week for the past 3 weeks. This amount has been deducted from the amount of rent owing.

I record that the landlord has been very concerned about the welfare of the tenant. She says that she has sent the tenant text and messenger texts which remain unread since the 4 March. She has made enquiries with the tenant’s flatmate who has not seen her since rent stopped being paid on the 18 March 2026 but believes that she may have been to the home during the period March to today’s date. The landlord has also made contact with known family members that have not seen the tenant during that time. The landlord has reported this to the Police.

The landlord has issued the tenant with notices requiring her to comply with her obligation to pay rent, but the rent remains in arrears.

The landlord believes that the tenant has abandoned the premises as her flatmate reports she is not living there. Disposal of goods

The landlord has applied for the disposal of goods that the tenant left at the premises at the end of the tenancy.

The landlord has been unable to contact the tenant.

The landlord is to try and attempt to contact the tenant to have her uplift her belongings from the house before midnight Sunday.

If the tenant has not uplifted the belonging by 6pm on Sunday the 10 May 2026, then the landlord may dispose of the goods as per the following paragraphs: a. She must take any personal identification document or other personal documents to the Police. b. She must sell or attempt to sell any items of value at a reasonable market rate (that is items that are likely to be sold for more than the storage, cost of sale and transport) c. The landlord may deduct any amount owing from the sale proceeds, and must pay the balance to the Bond Centre.
