Reasons
- The landlord attended the hearing by video.
- The tenant did not join the hearing by either the video link or dial-in instructions in the Notice of Hearing. The tenant has been served with the application, and Notice of Hearing.
- The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
- Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
- The landlord provided rent records which prove the amount owing at the end of the tenancy.
- The landlord also applied for termination of the tenancy for abandonment as an alternative to termination for rent arrears.
- The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.
- The landlord did not provide enough evidence to show that is more likely than not that the tenant has abandoned the premises.
- The tenancy is terminated under s55(1)(a) for rent arrears. As such the landlord is entitled to rent to 30 April 2026.
- As the landlord was the successful party, I have also awarded reimbursement of the Tribunal application fee. The bond will be paid to the landlord.
- Once he has possession of the property, the landlord will make another application for clean-up costs and damage.
