Goodwin Realty Limited T/A Goodwins As Agent For Pejman And Emma Okhovat As Trustees Of Okhovat Family Trust must take any of the tenant’s personal documents that have been left at the premises to the nearest Police station and obtain a receipt for them.
The landlord shall dispose of the other goods left at the premises by the tenant by: a. selling all goods with a saleable value by public auction or by private contract at a reasonable market price, and b. disposing of all goods with no saleable value as the landlord sees fit.
The amount owing to the applicant out of the proceeds of any sale is $1,326.84.
Goodwin Realty Limited T/A Goodwins As Agent For Pejman And Emma Okhovat As Trustees Of Okhovat Family Trust must pay the proceeds of any sale, less the amount owing, to the Bond Centre together with a copy of this order.
The claim for cleaning is dismissed.

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986. The tenant is also required to remediate all minor alterations made during the course of the tenancy. See sections 42A and 42B Residential Tenancies Act 1986.
The tenant did not return the keys and the tenant did not remediate a catflap they installed at the property.
The amounts ordered are proved.
The landlord has applied for the disposal of goods the tenant left at the premises at the end of the tenancy.
The landlord is unable to contact the tenant.
The landlord may deduct any amount owing from the sale proceeds, and must pay the balance if any to the Bond Centre. See sections 62(3)(b), 62B(2),(3) and (4), 62C(1)(b),(2) and (3) Residential Tenancies Act 1986).
The landlord may dispose of any goods that have no saleable value.
On the day of the hearing the landlord also applied for $442.75 for touch-ups to walls and cat/dog door repair, and for $598.00 for replacement and installation of remotes. These amounts were not included in the original application. The tenant has not had the opportunity to consider them and oppose the application if they saw fit. These claims are dismissed.
The landlord did not provide supporting evidence for the cleaning costs, and offered to withdraw the claim.
Because Goodwin Realty Limited T/A Goodwins As Agent For Pejman And Emma Okhovat As Trustees Of Okhovat Family Trust has substantially succeeded with the claim I have reimbursed the filing fee.
