This tenancy ended on 17 January 2023. The application was filed by the landlord with Tenancy Services on 1 June 2023.

Section 91A RTA provides that where a landlord files an application more than two months after the termination of the tenancy, any notice must be served on the tenant either: • Personally; or • By posting it to an address provided by the tenant within 2 months before the application; or • By delivering it to where the tenant now lives and leaving it with someone who appears to be over 16 years of age; or • By giving it to the tenant’s solicitor or authorised agent.

Service on this tenant was carried out by sending the documents to the tenant’s email address. Notice of the hearing was sent by SMS to the tenant’s mobile phone.

Substituted service can be ordered by the Tribunal. Section 91B (2)(b) RTA allows the Tribunal to direct that the notice or any other document be treated as served if steps have been taken that are likely to have brought the notice to the attention of the party.

The landlord gave evidence that emails from the landlord were sent to the tenant’s email address in April 2023 regarding a refund of overpaid rent. The landlord advised that the tenant made contact as a result of those emails and believes that the email account remains current.

The landlord advised and provided evidence that she had contact with the tenant by text messaging until 26 April 2023.

I find that emails sent to the tenant’s email address and SMS messages sent to her mobile phone are likely to have brought these proceedings to her attention. I order that the proceedings are to be treated as having been served on the tenant.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.

The landlord provided photographic evidence that the tenant did not leave the premises reasonably clean and tidy and did not remove all rubbish.

The amounts ordered are proved.

Because Palmerston North City Council has wholly succeeded with the claim I must reimburse the filing fee.
