Reasons

The landlord’s application sought rent arrears, methamphetamine related costs, re-glazing broken windows, repair / replacing of doors, replacement of a heat pump remote, and interior painting.
The first hearing took place in September 2023. I made an order in respect of the claim for rent arrears, methamphetamine related costs, and re-glazing broken windows. The bond was released to the landlord.
The landlord was awaiting final costs in respect of the other parts of the claim. The hearing was adjourned. The second hearing took place in Kaikohe on 29 February 2024.
Ms Robinson and Ms van Engelen represented the landlord at the hearing. There was no appearance by the tenant.
The front and back door and two internal doors were badly damaged during the tenancy. The cost of repairs and replacement (where necessary) is proven.
The cost of replacing the missing heat pump remote is proven.
There was extensive damage to internal walls during the tenancy. The tenant arranged for some basic repairs, leaving numerous patches. The extent of damage is such that the claim for a complete internal re-paint is fair and reasonable.
The premises were painted shortly before the start of this tenancy in March 2020. The cost of that job was $1,965.00. The cost of the re-paint at the end of this tenancy was $4,000.00.
It is appropriate to apply depreciation having regard to the duration of the tenancy and the fact that the 2020 re-paint appears to have been a more basic job than the one carried out at the end of the tenancy.
Having regard to those factors I will apply depreciation of 40%.
The landlord has been successful in this application, and I must also award the landlord the filing fee of $20.44.
