Reasons

The tenancy was terminated following a breach of a mediated conditional termination order.
The application seeks rent arrears, repairs, rubbish removal, and other costs.
Both parties attended the hearing. Ms Levi represented the landlord.
The application sought rent arrears to 5 May 2023. At the hearing, Ms Levi clarified that the tenancy was terminated on 20 April, but rent was sought to 5 May on the basis that the property could not be re-let until repairs and rubbish removal was done.
The obligation to pay rent ends when the tenancy ends.
The rent record establishes rent arrears of $192.86 as at 20 April 2023. I have addressed the claim for loss of opportunity to rent separately below.
Ms Hewson accepted the claim for repairs, and for replacement of missing lightbulbs.
Ms Hewson accepted the claim for rubbish removal, except for beds and mattresses shown dumped on the exterior of the property in the landlord’s photographs. Ms Hewson submitted that the beds do not belong to her. It is possible that local residents may have added to the pile of rubbish after Ms Hewson was evicted.
The claim seeks $566.00 for rubbish removal per an invoice from Far North Property Maintenance Ltd. I accept Ms Hewson’s oral evidence about the beds and mattresses. I will award $480.00 for rubbish removal.
The claim seeks $80.00 for lawnmowing. Ms Hewson submitted that he had the lawns mowed regularly when she lived there, but the ground was too wet to mow at the end of her tenancy. Ms Levi’s photographs show that the lawns were reasonably tidy. Ms Levi confirmed that the ground was wet at that time. I accept that it was reasonable for the tenant not to mow and risk damage to the lawns.
As noted above, the claim seeks loss of opportunity to rent.
Landlords must reasonably expect some “turn around” between tenancies.
In this instance, the rubbish removal work could have been done more or less immediately after the landlord re-took possession. I accept that the repairs, which included replacement of three doors, took longer. The repairs meant that there was some amount of delay in the opportunity to re-let the premises.
I will award loss of rent of $450.00.
The landlord has been successful in this application and I will award the landlord the filing fee of $20.44.
No bond was paid for this tenancy.
