The tenancy agreement records a tenancy start date of 22 January 2022. The parties agree that the last day of the tenancy was 19 April 2023.

The landlord has applied for payment of rent owing and for other costs. Some of the evidence was unclear or incomplete so I was not fully able to rely on it.

The tenants gave helpful oral evidence which assisted the Tribunal to make these orders.

I summarise each of the claims and my decisions below: a. Rent owing: the tenants say that the rent ledger is probably correct. This shows rent owing of $1,994.77. b. Rubbish disposal: the tenants agree that they left two couches, a bed and mattress, some household items and plastics, and two rubbish bags stacked outside near the fence. The evidence of the exact cost to dispose of this was unclear because the landlord also had other items taken away at the same time. I award a total of $450.00 which is about the cost of a large skip bin and an allowance for labour. c. The claim for carpet cleaning is dismissed. It is not proven this needed doing and only one room in the house had carpet, so the claim amount was too expensive. d. Repair of lounge window: one of the young children in the tenants’ family broke this and the tenants accept responsibility. I award the amount shown on an invoice of $190.00+GST which is $218.50. e. Plaster and paint two holes in hallway wall and two dents in bedroom walls: these happened as part of normal living but are more than “wear and tear”. The final inspection report notes that the tenants took responsibility for these at the final inspection, and they confirmed this today. The invoice is for $650.00+GST which is $747.50. I deduct $147.50 (one repair was for a hole behind a door that the tenants say was there at the start of the tenancy). I award $600.00. f. I award the filing fee as the landlord has proven most of the claims.

The landlord confirmed at the end of the hearing that these are all the claims it wished to pursue. I take from this that any other claims are withdrawn.

The bond is refunded to the landlord.

The parties left the hearing on good terms. They agreed to a repayment plan of the amount left to pay, which I have recorded. It was not possible for me to set this up as an attachment order, but I encourage them to work together to apply for this as it will be the cheapest and quickest solution for them all.
