Reasons

Only the applicant landlord attended the hearing. The tenant representative could not be contacted.
The landlord has applied for compensation, partial refund of the bond, and reimbursement of the filing fee following the end of the tenancy. What is the rent position at the end of the tenancy
Sadly, Mr Hancy died earlier this year. The property manager became aware of this when she went to the property to deliver a notice informing Mr Hancy of the next property inspection. His ex partner was there and informed her of his death, and that he had two children. His ex partner, who is also the mother of his two children, was staying at the house while she attended to removing his possessions and settling other matters. She advised that Mr Hancy did not have a Will.
The tenancy ended on 5 June when the tenants ex-partner returned the keys.
The rent was paid until 6 June, so the one day rent credit is to be paid to his Estate. The landlord provided rent records which establish the rent position at the end of the tenancy.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986. The tenant is required to replace worn out smoke alarm batteries during the tenancy. See section 40(1)(ca) Residential Tenancies Act 1986. The tenant must also replace standard light bulbs.
The tenant did not leave the premises reasonably clean and tidy, and did not remove all rubbish.
The amounts ordered are proved and to be deducted from the Bond.
The balance of the bond will be held by the bond centre, pending further directions from the Estate as to how it can be disbursed.
Mr Hancy’s partner should now contact the bond centre to discuss what evidence they will need so that the bond can be distributed, probably to his children.
Because Property Brokers Limited has wholly succeeded with the claim I must reimburse the filing fee.
