The tenancy of Ning Li at Unit/Flat 606, 24 Library Lane, Albany, Auckland 0632 is terminated, and possession is granted to Albany Apartments Management Limited as agent for Robert William and Suzanne Saunders, immediately.
Ning Li must pay Albany Apartments Management Limited as agent for Robert William and Suzanne Saunders $798.58 immediately, as calculated below:
The Bond Centre is to pay the bond of $2,200.00 (6276101-011) to Albany Apartments Management Limited as agent for Robert William and Suzanne Saunders immediately.

Reasons

Mr Dai represented the landlord. The tenant did not attend the hearing.
The landlord has applied for termination of the tenancy, rent arrears, lock and key replacement, refund of the bond, and the filing fee.
The application for termination was based on a breach by the tenant using the premises for an illegal purpose. A search warrant for the premises was issued by the District Court at Auckland on 21 June 2023.
I accepted an amendment to the application today. The application is amended to include an application for termination for rent arrears.
The rent is at least 21 days in arrears today. That means that the landlord can apply to terminate the tenancy.
The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
The landlord provided rent records which prove the amount of rent owing today.
The tenant has abandoned the tenancy which itself is a (separate) ground for termination. The landlord found the premises empty on 4 July 2023 when he conducted an inspection. Rent was in arrears then.
The landlord has had to incur costs for changing the locks and security passes because the tenant did not return the keys when he abandoned the premises.
I have further amended the application to include those costs, proved by the production of an invoice produced today.
As the application is successful, the tenant must pay the landlord’s Tribunal filing fee.
