Reasons

The landlord attended the hearing via teleconference. An attempt was made to contact the tenant however this was unsuccessful. The telephone call to her mobile number went straight to voicemail.
The landlord has applied for compensation in respect of cleaning, lock change, junk removal and reimbursement of the filing fee following the end of the tenancy.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986. The tenant is required to replace worn out smoke alarm batteries during the tenancy. See section 40(1)(ca) Residential Tenancies Act 1986. The tenant must also replace standard light bulbs.
The tenant did not leave the premises reasonably clean and tidy and did not remove all rubbish.
The landlord confirmed that all rubbish has now been removed and disposed of. He also confirmed that he no longer requires a disposal order.
The tenant did not return the keys. The landlord advises that the lock was a standard door lock and that the owner has now chosen to replace the lock with an expensive modern electronic lock (e-lock).
The landlord provided evidence in the form of invoices for all claims. I was also provided with photographic evidence in support the cleaning and junk removal claims. Having sighted the evidence in respect of cleaning and rubbish removal I am satisfied that the tenant is responsible for the two amounts claimed.
The amounts ordered for cleaning and rubbish removal are proved.
The claim for lock replacement is refused. It is not for the tenant to pay for an upgrade of the landlord’s property.
Because T.M.T. New Zealand Limited has wholly succeeded with the claim I must reimburse the filing fee.
