Reasons

Both parties attended the hearing.
The Landlord has applied for rent and water arrears and has provided rent records which prove the amount owing. The Landlord also claims the cost of cleaning the rangehood following the tenancy, and the cost of having a contractor mow the lawns of the Tenant’s behalf. Rent
The Tenant did not dispute that he had not paid the last week of rent. I award the Landlord one week of rent: $400.00 Water and Lawns
The Tenant says the Landlord agreed that he would not have to pay for water or lawncare, but he could point to no express agreement regarding this or give specifics about what the Landlord had precisely said in this regard.
The Landlord’s evidence is that he allowed the Tenant to use his lawnmower to mow the lawns to help him out. Then, when he grew tired of having to transport his personal lawnmower back and forth to and from the premises, he told the Tenant he would pay a contractor to do it and the Tenant, according to him, nodded in agreement.
I cannot be satisfied on the evidence that there was an agreement for the Landlord to take responsibility for the lawns, but neither can I find the parties agreeing to the use of a contractor.
For this reason, the Landlord’s claim for the cost of having a contractor mow the lawns must fail.
The Landlord confirmed the Tenant’s water use was exclusively metred. It is the Tenant’s responsibility to pay for the water he used.
The Tenant could not point me to any clear agreement that the Landlord would cover the cost of his water use, or that it was to be included in the rent he paid.
In the end I could not be satisfied there was any waiver by the Landlord of the Tenant’s obligation. I award the Landlord the balance of the water charges owed by the Tenant: $1,642.81 Cleaning
The Tenant is required to leave the premises clean and tidy at the end of their tenancy. The Landlord claimed the Tenant did not properly clean the laundry and kitchen before he moved on. The Landlord invited the Tenant back to clean, but he did not do a proper intensive clean, and the rangehood was left full of cooking oils. I have seen pictures of the kitchen and laundry and I consider the Tenant could have done a better job of cleaning the kitchen and the rangehood and I award $210.00 for the cost of cleaning these.
Because Weiguo Wang has substantially succeeded with the claim I have reimbursed the filing fee.
