The application sought rent arrears to 8 May 2023, cleaning, and carpet cleaning costs.
Both parties attended the hearing in Kaitaia on 17 October 2023. Ms Levi represented the landlord.
The tenancy ended on 28 April 2023.
The landlord seeks rent arrears to 8 May on the grounds that the tenant failed to remove all of his personal property until that date.
Mr El Karamany acknowledged that he did not remove all of his belongings until 8 May. Mr El Karamany submitted that he had re-located to Auckland, and there were two break-ins at the property in the last week, which made things challenging for him.
The tenant’s obligation to pay rent ends when the tenancy ends 1 . If a tenant leaves belongings behind at the end of the tenancy, the landlord must store those belongings and attempt to contact the tenant to retrieve them. A landlord can charge reasonable storage for that period.
It is appropriate to make an award of compensation to the landlord for involuntarily storing the tenant’s property for a period of ten days after the end of the tenancy.
I will award $200.00.
The landlord’s rent record shows that the rent was paid up to 24 April. Rent is owed for the last four days of the tenancy.
The claim seeks cleaning costs of $1,540.08 per an invoice from Shepherd Farms, and carpet cleaning costs of $230.00 per an invoice from Barkers Cleaning.
Ms Levi provided some photographs from the end of the tenancy. The main focus of the photographs is the belongings left behind, but some of the photographs relate to cleaning. There is one photograph of a stain on the carpet.
Mr El Karamany submitted that he cleaned to the best of his ability given the break-ins and the overall condition of the property (Mr El Karamany submitted that there were leaks at the property that caused mould).
The carpet cleaning invoice notes “carpet is old wool with a lot of old stains”.
It is not proven that new stains occurred during the period of this tenancy.

I will award $600.00 for cleaning, based on 15 hours at $40 per hour.
The landlord has been partially successful in this application and I will also award the landlord the filing fee for this application.
