Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit under section 40(1)(e)(ii)-(v) of the Residential Tenancies Act 1986.

The tenant did not return the keys and did not remove all rubbish and personal items from the house.

The landlord has provided an invoice from a locksmith showing the cost to change all the locks on the property. The cost of replacing the locks including an allowance of two hours for labour was $308.78 inclusive of GST.

The locksmith’s invoice also includes the supply and fitting of new padlocks to both the main gate and the side gate at the premises. I am not presently satisfied that the tenant should be liable for these new security measures. However, as this matter was not directly addressed in the hearing, I reserve that claim (for which I have allowed $138.00 for the materials and $46.00 for an additional half an hour of labour totalling 184.00 inclusive of GST) which can be raised in any subsequent related proceedings before the Tribunal which I anticipate would be in relation to compensation for cleaning and disposal of goods.

The landlord provided photographic evidence of furniture and numerous miscellaneous items left in the house at the end of the tenancy.

The landlord provided an invoice showing the cost of removal of these items to the carport for storage to enable the interior of the house to be cleaned, being $57.50.

The amounts ordered are proved.

The landlord has also applied for the disposal of goods the tenant left at the premises at the end of the tenancy.

The landlord gave the tenant additional time to move out of the property following the termination and possession order and has tried to contact the tenant on many occasions to arrange for the removal of the tenant’s goods.

The landlord is unable to contact the tenant.

It is not practicable for the landlord to the return the goods to the tenant. The value of the goods is below the cost of storing, transporting and selling them. Therefore the landlord may dispose of the goods under sections 62(3)(b), 62B(2) and (3) of the Residential Tenancies Act 1986.

As Braziers Limited as agent for Tomik Holdings Ltd has substantially succeeded with the claim I must reimburse the filing fee.
