The landlord has applied for rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.

How much is owed for rent?

The tenancy was for a fixed term until 10 January 2024. The tenant left early, without advising the landlord. The landlord subsequently accepted the early termination but asked for rent until a new tenant was found and the costs of finding a new tenant.
The landlord provided rent records which prove the amount of $1,412.86 owing for rent.
The landlord also provided an itemised breakdown of the time and cost incurred in finding a new tenant. Those costs have been presented to the tenant and are reasonable. I award costs of $467.76 for securing a replacement tenant.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
The landlord claimed that tenant did not leave the premises reasonably clean and tidy, and did not remove all rubbish. I accept the landlord’s oral evidence in relation to cigarette smells throughout the property and the need for deodorising. A receipt was provided for that cost. I award $230.
The landlord also claimed cleaning costs of $101.50 and provided an invoice. However, there were no photographs of the property before the cleaning was completed. The landlord’s description of the cleaning work did not satisfy me that the property was not reasonably clean and tidy at the end of the tenancy. The claim for cleaning costs is dismissed.
As the landlord was substantially successful, I have awarded reimbursement of the filing fee.
