Both parties attended the hearing.
The landlord sought the insurance excess incurred after methamphetamine contamination was discovered during the end of tenancy testing. The owner has successfully made an insurance claim for remediation.
The insurance excess sought in the application was $2500.00 but at the hearing the landlord revised it down to $1,200.00 to accurately reflect the excess as stated in the tenancy agreement, that being $1,2000.00. That reduction is fortuitous for the tenants.
Typically an order relating to methamphetamine contamination in a residential tenancy would detail the testing steps and results. In this hearing, after both parties made submissions, the tenants accepted liability for contamination and their liability for the insurance excess. Given this, I do not traverse the usual subject matter but note the contamination was above that considered safe by the Tribunal.
I also note the evidence provided by the landlord to establish a baseline equivalent confirms the contamination more than likely occurred in the early stage of the tenancy when another person was also residing at the premises. If such consumption continued during the tenancy, I would have expected the “baseline” test sites to have much higher readings. I consider it a fair possibility this person was the source of the contamination, as suggested by the tenants. That does not absolve the tenants of their responsibility and they accepted this.
