The tenancy ended on 3 November 2023. Prior to the end of the tenancy the parties attended a mediation on 19 October 2023. An order was made directing the tenants to pay $6824.29 in rent arrears. The bond of $3400.00 was released to the landlord to offset the debt owed to the landlord for rent arrears.
The mediated order set out an agreement that the tenants would pay $20.00 per week towards the remaining rent arrears of $3424.29. The tenants have not paid any money to the landlord for the remaining rent arrears.
I incorporate this previous mediated order in this order. The remaining outstanding rent arrears is $3424.29.
The landlord provided water rates invoices which prove the amount of $212.02 owing at the end of the tenancy.
I am satisfied that the landlord has proven her claims for the outstanding rent arrears and water bills.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii) -(v) Residential Tenancies Act 1986. The tenant is required to replace worn out smoke alarm batteries during the tenancy. See section 40(1) (ca) Residential Tenancies Act 1986. The tenant must also replace standard light bulbs.
The tenant did not leave the premises reasonably clean and tidy and did not remove all rubbish.
The landlord has provided an exit inspection report and photographs showing the condition of the property at the end of the tenancy.
The property was left dirty and untidy, the lawns were overgrown, and rubbish was left throughout the inside and outside of the premises.
The tenants left beds, racks, clothing, drawers, and kitchen items inside the house that the landlord had to remove.
Outside the tenants left an old broken trampoline for the landlord to remove.
The landlord provided the Tribunal with invoices for the cleaning, lawns, rubbish removal from PYO Management for $1760.00. In additional an invoice for $760.00 for the cost of 2 skip bins needed to remove the trampoline, household items and rubbish left at the property.
The amounts ordered are proved.
Because Pro Management (Auckland) Limited as Agent for Bi Yun & Silun Liang has wholly succeeded with the claim I must reimburse the filing fee.
