Reasons

The landlord attended the hearing by phone. Two attempts to reach the tenant were unsuccessful.
The landlord confirmed that on 22 February 2024 he sent the tenant copies of everything that he filed with the Tribunal.
The landlord has applied for rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.
The tenancy ended on 28 December 2023. The landlord provided rent records which prove the amount owing at the end of the tenancy was $3,600.

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy and remove all rubbish.
The landlord provided photographs showing that tenant did not leave the premises reasonably clean and tidy, and did not remove all rubbish. There was a considerable amount of rubbish, including paint and furniture abandoned outside.
There were dead birds attracting insects and so some insect bombs were required.
The landlord submitted an invoice for rubbish removal, including truck hire, tip fees and insect bombs totalling $903.00.
The amount ordered is proved.

Is the tenant responsible for the damage to the premises?

The landlord claimed $300.00 for carpet repair for which he provided an invoice. He had a photograph showing a large white mark that he believed was a paint spill that happened during the tenancy. He said that the carpet was only two years old. He was able to get a square of carpet the same and match it.
I am satisfied that the damage was more than wear and tear. The tenant has not proved that she did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission. See sections 40(2)(a), 41 and 49B RTA.
The amount ordered is proved.
Because Vgrs Investments Limited has wholly succeeded with the claim I must reimburse the filing fee.
