Background:

Both parties attended the hearing by teleconference.
During the hearing I adjourned for fifteen minutes for the property manager to email through to the Tribunal the exit inspection photos. The tenant advised that he would not receive the email because he had blocked the email address. I advised him that the tribunal would send them to him once we received them.
When the matter was re called the tenant advised that the property manager emailed him and should not have as he was blocked and therefore, he wanted to come down in person to a “re hearing”. I advised that a rehearing is applied for at the conclusion of a hearing and that I was going to continue the hearing and give a decision based on the evidence before me.
The tenant advised that he would not answer any further questions. He refused to answer the following question however continued to engage thereafter.
At the conclusion of the hearing, I asked if both parties had anything further that they wished to ad and both answered that they did not.
The landlord has applied for rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.

How much is owed for rent?

The tenancy ended on 19 February 2024. The tenant was in a relationship, and she was also a tenant however gave notice and was removed from the tenancy on 18 January 2024.
Whilst the current tenant states that the costs are all the responsibility of the other tenant that is incorrect. The previous tenant’s tenancy ended on 18 January 2024. The rent was reduced for a two week period following this. The landlord provided rent records which prove the amount owing at the end of the tenancy and I accept the amount is owing by this tenant.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986. The tenant is required to replace worn out smoke alarm batteries during the tenancy. See section 40(1)(ca) Residential Tenancies Act 1986. The tenant must also replace standard light bulbs.
The tenant did not leave the premises reasonably clean and tidy, and did not remove all rubbish.
Again the tenant blames the previous tenant advising that items were hers and the clean-up was also her responsibility. As stated, this is incorrect as the remaining tenant on the tenancy is responsible for the final clean-up. Whilst the tenant states he will not be paying I order the amounts as sought.
The amounts ordered are proved.
Because Pride Property Management Limited As Agent For L & C Hilton has wholly succeeded with the claim I must reimburse the filing fee.
