Alan Rudolph and Matanoanoa Joan Araipu must pay Jdl Premier Asset Management Limited As Agent For Thomas Wahid $6,735.05 immediately, calculated as shown in table below (“the debt”).
Alan Rudolph and Matanoanoa Joan Araipu must repay the debt as follows: a. By 67 weekly payments of $100.00 each Thursday, commencing on Thursday 1 August 2024 and ending on 13 November 2025; and b. A final payment of $35.05, to fully repay the debt, to be paid on Thursday 20 November 2025; and c. Where the tenants’ financial circumstances improve, the tenants have agreed to contact the landlord to make arrangements to increase the weekly amounts payable.
If Alan Rudolph and Matanoanoa Joan Araipu fail to pay debt repayments within 2 working days of the due date, the full amount of the remaining debt will fall due immediately.

Reasons

The landlord attended the hearing. The tenant did not.
I am satisfied that the tenants had received proper notice of the hearing time, date and place and chose not to attend.
The landlord has applied for rent arrears, compensation, and reimbursement of the filing fee following the end of the tenancy.

How much is owed for rent and water rates?

The tenancy ended on 27 March 2024. The landlord provided rent records and water rates invoices which prove the amount owing at the end of the tenancy.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
The tenants did not leave the premises reasonably clean and tidy and did not remove all rubbish. The landlord has proven the lawns and gardens were not left in a reasonably clean and tidying state, that the lawns required mowing and the garden tidying and it provided proof of the resulting costs it incurred.
The tenants have accepted liability for the rubbish they left behind at the end of the tenancy, which the landlord has proven it had to pay to dispose of.
The tenants have also accepted liability for the costs the landlord incurred undertaking pest treatment at the property after the tenancy ended.
The amounts ordered are proved. Reimbursement of the filing fee
Because Jdl Premier Asset Management Limited As Agent For Thomas Wahid has wholly succeeded with the claim I must reimburse the filing fee.
