Reasons

This hearing was conducted by teleconference. Only the landlord, represented by Ms Rockwell, attended the hearing. The tenant was unable to be contacted on the telephone number provided.
This tenancy began on 28 May 2018 and ended on 18 October 2023, following an order of the Tribunal terminating the tenancy. The landlord has applied for compensation for cleaning costs and removal of rubbish following the end of the tenancy. A disposal of goods order is no longer sought. Cleaning and rubbish removal
At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) of the Residential Tenancies Act 1986.
The landlord claims the tenant did not leave the premises reasonably clean and tidy, and did not remove all rubbish. The landlord provided oral evidence at the hearing that furniture and appliances were left behind, and cleaning was required, especially the carpet and kitchen. The invoice for cleaning, along with email confirmation of the rubbish removal costs, has been provided. While rubbish removal costs of $272.60 and $244.78 were incurred (making a total of $517.38), the landlord only seeks costs up to the remainder of the bond ($153.96).
The landlord was to have forwarded the photographic evidence after the hearing, which has not been received. However, in this instance, in view of the other evidence provided, and the surrounding circumstances, the costs claimed for cleaning and rubbish removal are awarded to the landlord. Filing fee
