The tenancy of Autumn Mihaere Hughes and Jayden Lewis Ross at Unit/Flat 4, 54 View Road, Henderson, Auckland 0612 is terminated, and possession is granted to Crockers Property Management Limited as agent for Sejal Patel, at 11:59pm on Wednesday 17 July 2024.
The Bond Centre is to pay the bond of $1,960.00 (6034363-031) to Crockers Property Management Limited as agent for Sejal Patel immediately.
Autumn Mihaere Hughes and Jayden Lewis Ross must pay Crockers Property Management Limited as agent for Sejal Patel $7,665.46 immediately, calculated as shown in the table below:
If the tenant repaints the damaged exterior wall before the end of the tenancy in a tradesman like manner, and in a matching paint colour, the amount owing will reduce to $7,377.96.

Reasons

Both parties attended the hearing (Mr Ross has left the tenancy and did not attend).
The landlord has applied for termination of the tenancy, rent arrears, compensation, and refund of the bond.
Rent was at least 21 days in arrears on the date the application was filed. Therefore, the Tribunal must make a final termination order, unless there is a realistic prospect of making a conditional order (s 55(1)(a) Residential Tenancies Act 1986).
Although the tenant would like to pay off the debt, I agree with the landlord that this does not appear realistic, given the amount owed.
The landlord says that, if the debt is paid in full before the termination date, it will discuss with the owner offering the tenant a new tenancy for the premises.
The landlord provided rent and water records which prove the amount owing at the end of the tenancy.
An exterior wall has been damaged during the tenancy. Although the damage has been repaired, the damaged area has not been repainted. The landlord has provided a quote for the cost of the work. However, if the tenant is able to repaint the damaged area before the tenancy ends to a reasonable standard, then the debt will reduce accordingly.
As the landlord has succeeded with the claim, I have reimbursed the filing fee. J P Smith 10 July 2024
