Reasons

The landlord attended the hearing today. I note that the tenants arrived at the hearing room at 2.25pm, after the hearing had concluded and 25 minutes after the scheduled start time.
The landlord applied for rent arrears, compensation, and reimbursement of the filing fee following the end of the tenancy. The bond has already been refunded to the landlord.
The landlord said the tenants had already left the premises before they handed back the keys on 1 March 2024. The landlord claimed rent in lieu of notice for 3 weeks to 21 March 2024. Rent records and water invoices were provided which prove the amount owing at the end of the tenancy on 21 March 2024.
At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit.
The property was left in poor condition. The landlord had to perform pest control to deal with insects.
The gardens were damaged by the tenants constructing a marquee on the lawn and from planting taro. The grounds had to be reinstated ($172.50).
A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage.
There was extensive damage to the walls of the premises during the tenancy. The wallpaper was ripped and there was writing on the walls (according to the landlord, every wall had writing on). The landlord had the walls repainted ($3,220.00) as this was cheaper than replacing the wallpaper.
The external siren for the security alarm had been dismantled as shown in the landlord’s photographs. The damage is more than fair wear and tear and the tenants have not disproved liability for the damage.
