This application was scheduled to be heard by video conference. Neither of the tenants linked in to the Teams meeting and so I rang them both twice on the mobile numbers provided for them. All the calls went to voicemail.
I am satisfied that the tenants received notice of today’s hearing and so I proceeded in their absence.
The landlord has applied for termination of the tenancy, rent arrears, reimbursement of an insurance excess, payment of the bond and reimbursement of the filing fee.

Should the tenancy be terminated?

The Tribunal shall terminate a tenancy where rent is 21 days or more in arrears at the time the application was filed or at the hearing date.
The rent is more than 21 days in arrears and so the tenancy is terminated. Rent arrears
I accept the rent record which shows that as at today’s date, the rent is $3391.53 in arrears. This amount includes a $745.00 rent payment made yesterday. The stove top
In situations which includes carelessness, tenants are required to pay for damage to the property which occurred during their tenancy and which they have not shown is fair wear and tear.
Where the landlord has insurance to cover the cost of repair, the tenants are required to reimburse the landlord for any excess payable.
In this case a stove top was cracked and without any evidence provided to the contrary, I accept that this was due to carelessness.
The tenants are therefore required to reimburse the insurance excess to the landlord which I accept was $500.00. Filing fee reimbursement
