The landlord has applied for rent arrears and compensation following the end of the tenancy. Rent
The tenancy ended on 17 July 2024 pursuant to a termination notice from the tenant. Cleaning and Rubbish Removal
At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit.
The tenant did not leave the premises reasonably clean and tidy and did not remove all rubbish.
The rubbish removal claim was reduced to $500.00 by the landlord at the hearing. The charges incurred, based on the weight of the rubbish removed, totalled nearly $2,400.00. However, the quantity of rubbish could have been disposed of in a skip bin, which would have cost much less.
On further review of the exit inspection report, I have reduced the cleaning costs awarded from $943.20 to $750.00. The photographs in the exit report show that the oven needed a major clean, and the kitchen cupboards were dirty. There were scuff marks on the walls, and a need for general cleaning of surfaces after removal of rubbish. However, the premises were not in a terrible condition. I consider the reasonable cost of bringing the property up to a reasonable standard of cleanliness to be less than the amount claimed. Damage
A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission.
Tenants are liable for the cost of repairing damage that is intentional or which results from any activity at the premises that is an imprisonable offence. This applies to anything the tenant does and anything done by a person they are responsible for.
The premises were badly damaged during the tenancy. There were large holes in bedrooms 1-3, the hallway, and the door to the shed. The damage would have required force. The safety latch on the gate was broken. The damage is more than fair wear and tear, and the tenant has not disproved liability for the damage.
Depreciation had been taken into account in the figures presented by the landlord.
