The tenant must pay the debt in order 1 at the rate of $50.00 per week.
The first payment must be made on Wednesday the 27 November 2024 and payments must continue every Wednesday until the debt is paid in full.
If the tenant fails to make any payment within 2 working days of the due date, the balance of the debt owing will be payable immediately and can be enforced through the District Court.
The Bond Centre is to pay the bond of $2,000.00 (3492240-015) to Oxygen.Co.Nz Limited As Agent For Kelvin And Richard Mclay immediately.

Reasons

Both parties attended the hearing.
The landlord has applied for rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.
The Tenancy began on the 19 July 2024 and was fixed for one year. Soon after the tenancy ended the tenant had to go overseas for an indefinite period.The tenant asked to be released from his tenancy.
The landlord re-let the property on the 26 September. The tenant is liable for rent until the 25 September. The landlord provided rent records which prove the amount owing.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986. The tenant is required to replace worn out smoke alarm batteries during the tenancy. See section 40(1)(ca) Residential Tenancies Act 1986. The tenant must also replace standard light bulbs.
Whilst the tenant did clean the property before leaving, there was a small amount of rubbish left behind which needed to be disposed off and then there was a small amount of cleaning required after the rubbish was removed.
The landlord only mowed the lawns once incurring a large fee for lawnmowing. I have reduced the amount owed by the tenant.
The amounts ordered are proved.
The tenant wants to pay the debt off and has agreed to pay $50.00 weekly in reduction of the amount owed.
Because Oxygen.Co.Nz Limited As Agent For Kelvin And Richard Mclay has substantially succeeded with the claim I have reimbursed the filing fee.
