Reasons

Only the landlord’s representative attended the video hearing. I continued the hearing without the tenant present as she has been emailed notice of the hearing date and time to her address for service. Her mobile went to voicemail when I called.
The landlord has applied for compensation for actual and estimated costs and refund of the bond following the end of the tenancy.
The tenancy ended on 15 September 2024 after the tenant gave notice.
The landlord seeks reimbursement of costs incurred for:- a. A plumber’s invoice in 2023 to unblock drains - $310.50; b. A plumber’s invoice in 2023 for a callout at the request of the tenant to check for a gas leak - $158.13; c. Changing the locks as keys were not returned at the end of the tenancy - $227.50.
The invoices were supplied and, as the claims have not been disputed by the tenant, they are awarded.
The claims for cleaning and garden work were withdrawn. The tenant arranged the cleaner herself before the final inspection was done. The landlord has no evidence to support a claim and did not authorise the work.
The remaining claims relate to damage.
A landlord must prove that any damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. See sections 40(2)(a), 41 and 49B RTA.
The landlord has supplied photographs proving that:- a. The handrail on the internal stairs was missing at the end of the tenancy; b. The paint surface over an area of wall in one bedroom was damaged and needs to be sanded, sealed and the wall repainted; c. One of the two pantry doors was missing.
The damage occurred during the tenancy and is more than wear and tear.
The above work has not been completed yet. After consideration of the evidence, I award the below amounts:- a. $1,034.72 being the quoted cost to replace and install the handrail on the stairs. This work is near completion; b. $400.00 to repair the wall in the bedroom. This is less than the quote of $690.00 to do the work. I award the lesser amount because the work has not yet been done. It is fairer to award the amount estimated in the application as this is the amount the tenant has been given notice of; c. $250.00 estimate based on the internet advertised price of a pair of similar replacement pantry doors ($169.00) and an allowance towards the labour cost to install and add handles. The work has not yet been done but I accept that it will be. The award is equal to the amount estimated in the application.
The landlord has substantially succeeded with the claims, so I award the filing fee.
The bond is refunded to the landlord in full and the balance is payable by the tenant.
No suppression orders apply.
