The landlord has applied for compensation and reimbursement of the filing fee following the end of the tenancy.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986. The tenant is required to replace worn out smoke alarm batteries during the tenancy. See section 40(1)(ca) Residential Tenancies Act 1986. The tenant must also replace standard light bulbs.
The landlord claimed the Tenant did not leave the premises reasonably clean and tidy. The Tenants also had a dog which was not permitted by the Tenancy Agreement.
The Tenant claimed the property was not professionally cleaned when they moved in. The tenant submitted at the end of the tenancy, they did their best to clean, including the windows and walls, and returned the property in good condition. However, they were upset because they were not given the opportunity to return and re-clean before the Landlord hired professional cleaners. The Tenant recalls using strong oven product.
The exit inspection report noted the floor coverings smelt of dog odour and further minor spot cleaning was required on the lounge wall, shower and the lounge sliding door tracks. The Landlord claimed the bedroom curtains required cleaning because the dogs odour had infused into the curtains. Photographs in the report showed the stains on the curtains. Invoices were also provided to substantiate the costs.
In considering the evidence, I am satisfied on the balance of probabilities, from the final inspection report that the unit required cleaning of the curtains and throughout the property. The Landlord is also not obliged to give Tenants a second opportunity to clean the property at the end of a tenancy.
The amounts ordered are proved.
As Far North Real Estate (2010) Limited As Agent For Mi Yeon Song has wholly succeeded with the claim the Tenant must reimburse the filing fee.
Neither party sought name suppression so this is not granted.
