The landlord’s application seeks rent arrears, water rates, cleaning, garden tidy up, and repair costs.
The hearing took place by phone on 10 January 2025. Mr Jet represented the landlord at the hearing. A few days before the hearing, Ms Epu contacted Mr Jet and said that she would be unable to attend the hearing but she did not dispute the landlord’s claim. I was unable to contact Bensita Paeniu.
The landlord’s rent record establishes rent arrears of $1,948.57 to the end of the tenancy.
Mr Jet provided a water rates ledger showing all of the water charges and water payments during the tenancy. There is a balance of $256.18 owed for water rates to the end of the tenancy.
At the end of the tenancy the tenant must leave the premises reasonably clean and tidy.
Mr Jet provided a copy of the exit inspection report. Some interior cleaning was necessary to bring the premises to a reasonably clean and tidy standard. The small garden was very overgrown. The amounts claimed for cleaning and garden tidy up are proven, and are fair and reasonable.
Tenants are liable for damage beyond fair wear and tear that occurs during the tenancy. The premises were new at the start of this tenancy.
The end of tenancy photographs show a badly damaged bathroom door and damage to walls in parts of the house (children’s writing, dent in entranceway, various scuffs and marks).
The damage is beyond fair wear and tear for this one-year tenancy.
The cost of repairs is proven.
The landlord has been successful in this application and I must also award the landlord the filing fee of $27.00.
The bond will be released to the landlord.
I note that Ms Epu previously offered to pay the outstanding balance at $50 per week, which Mr Jet indicated was acceptable to the landlord.
