Reasons

The landlords attended the hearing as did Ms Alexis. I rang the number provided for Ms Ambrose twice and both times my calls went to voicemail. I later learned from Ms Alexis that Ms Ambrose, her daughter, did not wish to attend the hearing.
The landlord has applied for rent arrears, compensation, payment of the bond, and reimbursement of the filing fee following the end of the tenancy.

How much is owed for rent and water rates?

The tenants signed a fixed term tenancy which began on 29 April 2024 and was due to expire on 28 April 2025. During the tenancy Ms Alexis advised the landlord that she was urgently needed elsewhere and that she wished to break the fixed term.
The parties then agreed that there would be a break lease fee of $575.00 and that the tenants would continue to pay rent until the beginning of a new tenancy.
Ms Alexis left the tenancy on 6 November 2024 and Ms Ambrose remained in the tenancy for a period, returning the keys on 21 December 2024.
Having begun advertising for a new tenant in November 2024, the landlords obtained a new tenant, the new tenancy to begin on 18 January 2025. They had reduced the rent payable to $750.00 per week.
Despite the agreement that rent would be payable until the beginning of the new tenancy, the landlord claims rent only to 21 December 2024 when the keys were returned.
I accept the rent record which shows that as at that date $7,103.57 was owing in rent.
I also accept that as at 21 December 2024 $207.74 is owing in outstanding water rates.

Did the tenants comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
The landlord claims $862.50 for the cost of cleaning the premises.
I have reduced this amount to $450.00 because the photographs provided do not warrant the amount claimed, given that the tenants are required to leave premises reasonably clean, not perfectly clean or to a standard that is required for an incoming tenant. I also reduced it because the amount claimed included the cost of vacuuming the premises whereas in fact the carpets were replaced.
I accept the evidence showing that rubbish was left at the premises, including a recycling rubbish tin full of mixed rubbish which needed to be dumped. Break lease fee
As discussed earlier the tenants are required to pay the break lease fee as they agreed to do. Filing fee reimbursement
The landlord was substantially successful in the claim they made against the tenants and so the tenants are required to reimburse them the cost of filing tis application in the Tribunal. Joint and several liability
Ms Alexis and Ms Ambrose are both named tenants on the tenancy agreement. They are therefore both jointly and separately liable to pay the amount ordered above. C ter Haar 15 January 2025
