The Bond Centre is to pay the bond of $2,520.00 (6541859-010) to Opes Property Management South Limited as Agent for B & V Whibley Property Ltd immediately.

Reasons

The landlord attended the hearing which was held by videoconference. The tenants did not attend and could not be contacted on the numbers specified in the Notice of Hearing which was served to e-mail addresses given by the tenants as service addresses in the agreement.
The landlord has applied for rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.

How much is owed for rent?

This was a fixed term tenancy from 14 June 2024 to 15 June 2025. The tenants wanted to end the tenancy early and signed a break lease agreement with the landlord.
New tenants were able to found. That tenancy started on 8 November 2024. The tenants are responsible for rent up to the date the new tenancy began.
The landlord provided rent records which prove the amount owing to that date

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
The landlord provided entry and exit inspection photographs which show that: a. the tenants did not leave the premises reasonably clean and tidy, with extensive cleaning work required; b. the carpets were dirty with some severe stains; c. there was significant marking and damage to wall surfaces.
The amounts paid by the landlord for cleaning and repair work are proved by invoices provided. The carpet cleaning cost is high but reflects the cost of a carpet steam clean, as well as stain treatments.
I have awarded a little less than the full cleaning cost to recognise that the tenants’ responsibility was to leave the premises reasonably clean and tidy, not turnkey ready for new tenants.
The amount claimed by the landlord for early break of the fixed term is reasonable and is supported by an itemised invoice reflecting what I accept are the expenses incurred by the landlord from the breach, in terms of s.44A RTA.
Because Opes Property Management South Limited as Agent for B & V Whibley Property Ltd has succeeded with the claim I must reimburse the filing fee.
