Both parties attended the hearing which was held by video conference. Ms Woodruff’s mother, Gayle, also attended (via a separate connection) as a support person. Ms Woodruff left the call shortly before the end of the hearing.

These claims relate to the tenancy of a property in Whangarei which began on 12 November 2021. The tenancy was originally for a fixed term of two years. On 5 September 2023 the parties entered into an agreement whereby they extended the term of the tenancy for a further two years, to 12 November 2025.

On 13 January 2025 the tenant applied to reduce the term of the fixed term of the tenancy.

However when the application was filed the landlord had already agreed to end the fixed term tenancy early on the basis that the tenant would pay rent until a new tenant was found and would pay the landlord’s reasonable expenses incurred in obtaining a new tenant.

The tenant worked with the landlord to find a new tenant. The tenant contacted friends who had indicated that they might want to take over the tenancy. The landlord moved quickly to advertise the property and to prepare and process those applications. New tenants moved in on 4 February 2025.

On 7 February 2025 the landlord filed a claim. The landlord seeks: a. Rent arrears to 3 February 2025 - $1,900.00 b. The cost of a replacement key - $16.00 c. Expenses incurred due to the tenancy ending early - $961.00 d. Reimbursement of the filing fee - $27.00 Rent arrears and key

The tenant had been in credit when she gave notice to end the tenancy but stopped paying rent towards the end of the tenancy. The landlord provided a rent summary showing the arrears owing. The tenant agreed that the rent was owing as shown on the rent summary. The order for rent arrears is made by consent.

The tenant also agreed that a key had been lost and that the landlord should be compensated in the amount of $16.00. The order for compensation for the lost key is made by consent. Expenses

The landlord provided an itemised list of expenses incurred by the landlord because the fixed term tenancy finished early. These include reimbursement for placing the trademe advertisement, the cost of identify and credit checks, time spent preparing applications and screening tenants including checking references, preparing and completing a new tenancy agreement, conducting an exit inspection and entry inspection for the new tenants, and time spent on phone calls and writing and sending emails.

The landlord did not charge the tenant for viewings as these were carried out by the tenant and did not charge for all of their mileage, time spent on reference checks, or for the cost of photos and videos taken during the inspections.

Ms Woodruff accepted the cost of the trademe advertisement and the credit checks but disputed the time and hourly rate charged for all other matters.

I have carefully reviewed all of the evidence filed. I accept that the costs claimed have been incurred by the landlord because the fixed term tenancy ended early. These costs would not have been incurred otherwise. I am satisfied that the costs are reasonable and that the tenant should compensate the landlord for the costs as itemised by the landlord (total amount $961.00). Filing fee and name suppression

The landlord has been the successful party and so is entitled to reimbursement of the filing fee. The landlord did not seek an order for name suppression. The tenant is not entitled to an order for name suppression. Payment

At the conclusion of the hearing the landlord indicated that when a lump sum Tribunal order is made they will usually consider entering into a payment plan with the tenant so that the sum ordered can be paid off over time. The tenant may wish to contact the landlord to discuss such an arrangement. Amendment

This order was amended on 17 February 2025 as the amount referred to as the amount sought by the landlord for reimbursement of the filing free was incorrect. This has now been corrected but the order is otherwise unchanged.
