Both parties attended the hearing. The landlord attended by video and the tenant attended by telephone.

Just prior to the hearing commencing the tenant had provided a medical certificate asking for the hearing to be heard in person. The reason given for this was so that she could have a support person attend with her and because she was having technical issues with her computer.

The tenant could have a support person with her regardless of whether the hearing is held in person, or by video or phone. I note that while the tenant was on the phone she was speaking to someone with her.

The tenant has known for two months that this hearing was to be held by video. I am not satisfied that there is sufficient reason for the hearing to be held in person. I therefore directed that the hearing proceeds with the tenant attending by telephone.

The landlord has applied for rent arrears, compensation, and reimbursement of the filing fee following the end of the tenancy.

How much is owed for rent?

The tenancy ended on 22 December 2024. The landlord provided rent records which prove the amount owing at the end of the tenancy.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.

The tenant did not leave the premises reasonably clean and tidy. The tenant did not mow the lawns.

The amounts ordered are proved.

The landlord claimed for moving the tenant’s belongings and rubbish removal. The tenant was unwell when she was required to vacate the premises. She asked the landlord to arrange for someone to move her belongings to her new tenancy. The agreement was that all the tenant’s belongings from inside the premises would be delivered to her together with certain listed items from outside the premises.

There is email correspondence from the landlord advising that the contractor took some items to the dump because he considered them to be rubbish and of no value. At the hearing the landlord said that the contractor misread the work order. The tenant says that she is missing important items such as a stereo, mantel clock and sets of books. She has made a complaint with the Police.

Given the error by the contractor and given that the tenant is missing some of her belongings I am unable to award the costs for the work carried out by the contractor. That part of the landlord’s claim is dismissed.

According to Tribunal records there is no bond held by the Bond Centre. The landlord said that the bond was released to a previous property management company. The tenant said that she had been advised that there is a bond held by the Bond Centre.

There is a Tribunal order 1 dated 26 April 2019 which released the bond to Waikato Real Estate Limited. While the tenant applied for a stay and rehearing it is possible that the bond was released before the order granting the stay of proceedings was made on 2 May 2019.

Because Eves Realty Limited Acting Agent For Lance Riches has substantially succeeded with the claim I have reimbursed the filing fee.
