The tenant was a WINZ client and the landlord assisted WINZ by providing accommodation to the tenant in its motel. Unfortunately, the tenant caused a lot of damage to the unit she was staying in. She left without giving any notice apparently taking some of the unit’s chattels with her.
Today, the landlord applies for rent arrears, compensation for its damaged and missing property and lost rent, and reimbursement of the filing fee.

The landlord’s contractor could not remove the graffiti, so the landlord had to replace the fridge with a second- hand unit. The microwave, which was new at the beginning of the tenancy, was burnt out through probably misuse given the tenant’s disregard for the premises. The landlord had to replace the microwave. The curtains, which were new at the beginning of the tenancy, were badly torn. The landlord had to replace them.
I am satisfied that the damage to the premises mentioned occurred during the tenancy and is more than fair wear and tear. The tenant has not proved that they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission. 2 1 Residential Tenancies Act 1986 (RTA) s 40(1)(e)(ii)-(v). 2 RTA ss40(2)(a), 41, and 49B.
Tenants are liable for the cost of repairing damage that is intentional or which results from any activity at the premises that is an imprisonable offence. This applies to anything the tenant does and anything done by a person they are responsible for. 3
Damage is intentional where a person intends to cause damage and takes the necessary steps to achieve that purpose. Damage is also intentional where a person does something, or allows a situation to continue, knowing that damage is a certainty. See Guo v Korck [2019] NZHC 1541.
The amounts ordered are proved.
I have considered betterment and depreciation. The landlord should be returned to the position they would have been in had the tenant not breached their obligations and should not be better or worse off. In calculating depreciation, I have considered the age and condition of the items at the start of the tenancy and their likely useful lifespan.
The landlord sought two weeks’ rent in lieu because it could not rent out the unit while it was repaired. I allow one week as the damage and replacement of missing items could reasonably have been carried out within that period. Filing fee
