The tenancy of Sapphire Hughes at 1A Rimu Street, Marton, Marton 4710 is terminated, and possession is granted to Paul Rodney Dansby, at 11.30am on Thursday 27 March 2025.
Sapphire Hughes must pay Paul Rodney Dansby $970.47 from the bond calculated as shown in the table below.
The Bond Centre is to pay the bond of $970.47 (6448989-002) to Paul Rodney Dansby immediately. The remaining bond of $1,229.53 is to remain at the Bond Centre.

Reasons

The hearing was conducted by telephone. Only the landlord attended. The call to the tenant at the time of the hearing went to voicemail.
The landlord has applied for termination of the tenancy for breach of the tenant’s obligations.
The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. See section 56(1) Residential Tenancies Act 1986.
Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days and establish that the tenant has failed to do so.
The tenant has breached her obligations by damaging the premises and subletting them without the landlord’s consent.
The landlord served a 14-day notice on the tenant on 29 January 2025, and the tenant has not remedied the breach.
It would be inequitable to refuse to terminate the tenancy because the damage is significant and the tenant has made no effort to repair it, pay the cost of repairing it or even communicate with the landlord about it.
As well, the tenant has not lived in the premises since November 2024. She sublet the premises or allowed her sister to take possession of them and now the premises are vacant. WINZ continues to pay the rent.
The landlord gave evidence and produced some evidence of the damage and the cost of repairing it. I have therefore awarded that cost. The landlord has other claims that were not supported by evidence, and he can file another application to claim those costs.
The landlord has succeeded and so I have awarded the filing fee.
The total award is less than the bond and the remaining bond will be held by the Bond Centre pending a further application.
