The Tribunal made an order in relation to this tenancy on 20 February 2025 terminating the tenancy for abandonment, awarding rent arrears to 28 February 2025, and ordering the bond to be paid to the landlord. That order has been incorporated in this order for enforcement purposes.

This was a fixed term tenancy ending on 1 August 2025. A new tenancy began on 1 March 2025 and so there is no additional claim for rent arrears. The Tenant’s Obligations.

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish and return all keys and security devices.

The tenant must not carelessly or intentionally damage the premises.

A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission.

Where the damage is caused carelessly, and is covered by the landlord's insurance, the tenant's liability is limited to the lesser of the insurance excess or four weeks' rent (or four weeks' market rent in the case of a tenant paying income-related rent).

Tenants are liable for the cost of repairing damage that is intentional or which results from any activity at the premises that is an imprisonable offence. This applies to anything the tenant does and anything done by a person they are responsible for. Claims

The tenant did not leave the premises reasonably clean or remove all rubbish and she did not return any keys or remotes.

There was impact damage to several walls during the tenancy. The damage is more than fair wear and tear, and the tenant has not disproved liability for the damage. The nature and extent of the damage leads me to conclude that the damage was intentional.

The carpet smelled strongly of cigarette smoke and required professional cleaning. Smoking inside the premises was prohibited by the tenancy agreement. The amount awarded for the cleaning was proved by the production of an invoice and by evidence from Mr Edwards.

The landlord claimed only the cost of hiring a trailer and dump fees for removing the items left at the premises by the tenant and I have awarded them in full.

The cost of changing the locks and replacing remotes was $820.22.

There was no evidence of the cost of repairing the wall damage, but it would have been substantial.

The landlord claims $750 to cover both these costs being the excess applied by the landlord’s insurer in respect of both claims together. Insurance is not relevant to the costs of lock changing, and so the tenant has received the benefit of the landlord’s decision not to claim that separately. I note as well that the insurer was generous to apply only one excess to the separate areas of damage. The landlord has also disregarded the fact that the damage was intentional.

The landlord incurred costs associated with the tenant’s abandonment of the premises including outgoing and ingoing inspections, advertising, credit checks and the cost of the agent’s time. I find that the amount claimed is reasonable and so I have awarded it in full.

There was a claim for the cost of replacing a seal to the washing machine which the landlord withdrew.

The landlord has succeeded and so I have awarded the filing fee.
